General Outdoor Burning Regulations

What can be burned? - In any fire, it is only legal to burn natural vegetation or firewood. It is against the law to burn anything else - even paper (except for the amount to start a fire).

Burn Barrels - The use of burn barrels is prohibited statewide.

Construction and demolition debris - It is a violation to burn any material resulting from a construction, renovation or demolition project.

Nuisance - Smoke, odor or ash that unreasonably impacts neighboring properties is illegal.

Burning is allowed during daylight hours only unless otherwise permitted by the Fire Warden. (Recreational fires are excluded from this restriction.)

Burn only when calm or with light winds that do not exceed 7-10 mph.

Types of Burning That Require a Permit

Recreational Fires - Larger than three feet in diameter and two feet high. Recreational fires are fine that consist only of charcoal or firewood that are used for cooking or pleasure.

Residential Fires - Larger than four feet in diameter. Residential fires are those consisting of leaves, clippings, pruning, and other yard and garden debris that are generated on site.

Land-clearing fires - fires consisting of trees, stumps, shrubbery, or other natural vegetation from land-clearing projects generated on site.

Land Clearing Permit Fee

Recreational Burning
(Recreational fires 3 feet in diameter or smaller do not need a permit if all conditions below are met.)

1. The fire is in an enclosure no larger than 3 feet across. The enclosure must be minimum of 16 inches high and made of cement block, stones or #10 gauge steel.

2. Materials being burned must be kept lower than the side-walls of the enclosure.

3. A charged garden hose or 2 five-gallon buckets of water must be on site.

4. A shovel or rake must be on site,

5. The fire must be 25 feet from any structure or standing timber.

6. Tree branches must be cleared to the height of 15 feet above enclosure

7. One person age 16 or older that is capable of putting the fire out must be in attendance at all times.

8. The fire must be contained in a firebreak (bare ground).

9. The landowner's permission must be obtained if not on your property.

Residential Burning
(Permits are required for fires over 4 feet. Fires less than 4 feet in diameter do not require a permit if they meet all of the following requirements.)

 


1. A shovel or rake must be on site.

2. For piles over 10' x 10' - a tractor with a loader, bulldozer or excavator with an operator must be on site at all times.

3. Water must be on site.

- Fires under 4 feet - must be a charged garden hose or 10 gallons of water and a bucket.
- Fires 4-10 feet - must have a charged garden hose or 55 gallon water source - with a pump and enough hose to reach the fire.
- Fires over 10 feet - must have a 300 gallon water source with a pump and enough 1-1/2" hose to reach around the entire fire.

4. One person age 16 or older that is capable of putting the fire out must be in attendance at all times and must have a method to contact 911 if needed.

5. Only one pile may be burned at a time unless permitted otherwise.

6. All fires must be contained within a firebreak (bare ground).

7. The fire must be 50 feet from any structure, standing timber or power lines.

8. The landowner's permission must be obtained if not on your property.

9. Permit - The cost of a permit is $20 and is valid for seven days.

Land-Clearing Burning
(Pile size must not exceed 30 feet in diameter.)

1. 3 shovels, 2 axes and a 5 pound ABC fire extinguisher must be on site.

2. A 300 gallon water source with a pump and enough 1-1/2" hose to reach around the entire fire must be on site.

3. One person age 16 or older that is capable of putting the fire out must be in attendance at all times and must have a method to contact 911 if needed.

4. The fire must be 50 feet from any structure, standing timber or power lines.

5. All fires must be contained within a firebreak (bare ground).

6. Only one pile may be burned at a time unless permitted otherwise by the Fire Warden.

7. The landowner's permission must be obtained if not on your property.

8. A backhoe, fan and bulldozer or excavator with an operator must be on site at all times.

Land Clearing Permit Fees

Land Clearing permit fee - is a minimum of $50.00 and is valid for seven days.
The Fire Warden must inspect all burn piles prior to burning.

No burning is allowed during a burn ban.

Civil penalties maybe assessed by the Fire Warden and / or the Northwest Air Pollution Authority for violations of outdoor burning laws.

Civil penalties range from $50 - $13,000.
